The present research examined means for the transfer of assets at the moment of death other than succession (succession substitutes) from the viewpoint of civil law, conflict of laws (private international law), and tax law.
From the viewpoint of civil law, we examined the modes and limitations of succession substitutes in Japan. As for conflict-of-laws issues, we reflected, in particular, on the necessity of a special choice-of-law rule relating to succession substitutes, and dealt with trust as an example of succession substitutes. Finally, with regard to tax law, we reflected on this issue from viewpoint of party autonomy and the neutrality of taxation.

This comparative study examined French law and Belgian law, as well as other jurisdictions such as English law, for the commonalities and the differences in their legal treatment of same-sex couples who live together. Based on these findings, the study then discussed challenges for same-sex couples in Japan and possible solutions thereto. The study has revealed that, in contrast to those jurisdictions that have already taken legal measures for the sake of same-sex couples, Japanese marriage law, which is characterized by the inequality between husband and wife, should be scrutinized in the light of these characteristics.

In those four years there have been a strong change of the family structure and the diversity of the family is extending more and more rapidly. In Europe and America, many countries have acknowledged the so-called domestic partnership or civil union between two adults, either homo-sexual or hetero-sexual, and re-marriages, step-families and recomposed families have been increasing. The parent and child relationship has also changed with the progress of the medically assisted procreations. The conflicts between the family members or domestic relations have been hard to be resolved and a new system of dispute resolutions with autonomy of parties and assistance of legal or non-legal professionals is needed. We have become a society in which there are an increasing number of people who are living completely without any relationships. The present state of the family law system and the desired legislation was considered.

This study has examined the legal constraints in French law on the contracts between various forms of couples, including marital contracts, pacte civil de solidalite[ PACS], and contracts between individuals in non-marital relationship. This comparative analysis suggests that, firstly, Japanese law should recognize the validity of intra-couple contractual clauses on economic interests unless they are made with the fraudulent intent. Secondly, contractual clauses concerning personal issues merit further analysis in Japanese context, with a particular focus on the nature of marriage and contract in Japanese law.

昨年度から引き続き、今年度9月まで、近年、婚姻関連法の改正などのダイナミズムが見られるフランスでの在外研究を行った。その結果、フランスでは、婚姻(法律婚)の本質は、子どもを産み育てるための基本単位、(夫婦とその子どもから成る)「家族」の基盤に求められる(したがって婚姻の異性愛性、内縁・パックスと親子法制との区別が帰結される)という伝統的考え方がある一方、近年では、そういった生殖の側面にとらわれない、婚姻の個人的・精神的次元の強化も確認される(これらについては、判例評釈、立法紹介の形で原稿を執筆し、現在校正段階である)。他方、離婚の容易化、共同親権の徹底、嫡出子・非嫡出子区別の撤廃などは、婚姻の特殊性・独自性を失わせるもののようにも見えるが、カップル関係と親子関係とを一体に規律する制度は、婚姻に留保されている。
では、日本の文脈ではどうなのか。これを明らかにするため、フランス在外研究から帰国した本年度後半は、日本の婚姻・内縁をめぐる総合的な裁判例分析により、日仏での「婚姻」概念の相違に迫った(北海道大学法学研究科に、「事前審査論文」として提出した)。
本研究の成果は、さらに検討を重ねたうえで、近日中に博士論文として完成させ、公表する予定である。
