Since mid-1980s, the number of mixed marriage - a couple of Japanese husband and non-Japanese wife (Chinese and Philippines) up surged in Japan. Consequently, the number of divorce also increased. Generally, a minor involved in such divorce need to maintain the relationship with a non-resident parent after divorce but it does not always happen that the parents make proper agreements on their child after divorce. As a result, a child is likely to face difficulties emotionally and financially due to no contact with the non-resident parent. In Korea, similar situation is observed in the case of marriage with a Chinese and Vietnamese wife. For the sake of child’s interests, further research should be done for collecting information on the situation of the child in such divorce.

In those four years there have been a strong change of the family structure and the diversity of the family is extending more and more rapidly. In Europe and America, many countries have acknowledged the so-called domestic partnership or civil union between two adults, either homo-sexual or hetero-sexual, and re-marriages, step-families and recomposed families have been increasing. The parent and child relationship has also changed with the progress of the medically assisted procreations. The conflicts between the family members or domestic relations have been hard to be resolved and a new system of dispute resolutions with autonomy of parties and assistance of legal or non-legal professionals is needed. We have become a society in which there are an increasing number of people who are living completely without any relationships. The present state of the family law system and the desired legislation was considered.

I have compared japanese adoption law with USA(Massachusetts),german,french,austrian,italian and New Zealand etc. adoption and its related law. This research discovers that a family member definitely needs financial, social and emotional support for coping with breakdown of family relationships due to an incident which the member is not responsible for, such as natural disaster, a crime done by other family member or traffic accident, and it reveals that damage in some cases appears regardless of generation such as damage by chemical weapon used during war. In order for reconstituting new relationship for their future, it is necessary for the government and private institution to provide various types of supports financially, socially and emotionally by considering the nature of damage and situation of family members based on the principle of individuality and to intervene into a case ex officio where the member is a vulnerable person such as a child. For making supports more effective, it is crucial to constitute a network of institutions for providing services not only domestically but also internationally.

Public Legal Education (PLE) includes all sorts of activities relating to access to justice which aims to provide useful information and skills for people confronting problems or in order to prevent them from having problems. Given that Canada has adopted PLE since late 60s while England set up a PLE task force newly in 2006 I have carried out research on theory and practice of PLE in both countries.
There are many kinds of PLE organizations provide various services under the name of PLE. Despite difficulty in funding is a common issue overall operations of PLE in Canada and England are rather different. It would be worth introducing PLE in Japan in order to promote people's participation in the judicial system for "one's own good", provided it needs to consider the activities of existing organization which provides PLE kind of services. It is also important to focus on foreign residents and vulnerable people as a main target of PLE, for realizing Japanese PLE as in globalize society.

(1) There are similarities and differences of principles and practices between Japan and England and Wales as for managements for dealing with family disputes, in particular divorce matters.
(2) Under the Personal Affairs litigation Act newly enacted in 2003, it is pointed out that there are incompatible principles in the proceedings for family disputes in order to resolve disputes properly. On one hand, it is emphasized that the procedure should be based on the paternalistic approach for protection of vulnerable members of a family, which seems to be familiar to Choutei procedure, but it is, on the other hand, claimed that it should also include the adversarial factors in order to secure the rights of the parties, which is regarded as a major element of ordinal litigation. Not only in the cases of divorce but also in the custody issues over minors after divorce of their parents, discrepancies in views of academics and practitioners over this issue still remain. For instance, one asserts that a child should be protected under the paternalistic approach of family courts and other relevant institutions when s/he is involved in parents' disputes while the other emphasizes that even a child should be regarded as a subject of the case and treated as one of the parties to divorce.
(3) In England and Wales, the divorce procedure is mainly based on the adversarial principle with some modified procedure, such as out of court mediation. It is observed that the rule of securing and protecting the rights of the vulnerable parties involved in divorce was made by a series of precedents referring to fairness and justice for the parties which might be achieved by well organized institution of solicitor.

This study aims at the history, current situation and legal system on domestic violence in Japan, China and Britain particularly by paying attention at the gender roles in society. In Japan, the issues on domestic violence rarely attracted society's interests until the 1990s. Accordingly, few victims obtained the legal remedies and assistance from society which was still based on the doctrine of traditional gender roles. A first step was taken when the DV Act 2001 was implemented for protecting the victims by domestic violence but the legal scheme and other services are not yet sufficient for both victims and perpetrators involved in domestic violence cases. In addition, it could be said that the philosophy and individual actions for dealing with domestic violence cases seem to be strongly influenced by the views of traditional gender roles. In China, the views of traditional gender roles remains in every corner of society and legal protection and social supports of the victims by domestic violence are insufficient. It is not widely recognized in society that the issue of domestic violence includes exactly the issue of human fundamental right. At the same time, the social status of women-the great majority of the victims-in many respects are behind those of men. In Britain, various actions including implementation of a series of new laws against domestic violence have been taken seriously for more than thirty years by providing physical safety and securing accommodation for the victims. However, British society still witnesses domestic violence cases including child abuse and granny bashing and is struggling for improving not only the legal system but also other relevant schemes with promoting cooperation among the authorities and private organizations such as non profit groups interested in domestic violence issues.
