Under the Consumption Tax Act, whether or not the provider of personal services falls under the category of "individual business operator" determines whether the provider himself must pay a consumption tax, and whether or not the consumption taxpayer who pays the consideration for the personal services to the provider can apply the input tax credit.
However, the Consumption Tax Act only defines "individual business operator" as "individual who conducts business" and there is no specific provision that clearly states the meaning of "individual business operator" in the Act.
Therefore, the question is whether to follow the criteria for distinguishing business income and salary income that is well established in income taxation case law, or to consider the concept of "individual business operator" peculiar to consumption taxation.
This paper presents the results of the reasonable interpretation of meaning of "business" in the Consumption Tax Act, by considering some typical cases in which the issue is whether the provision of personal services falls under the category of "business" and by examining how to take up the concept of "business" in the judgment of those cases, which are divided into two types of proceedings where the consumption taxpayer who pays the consideration to the personal service provider appeals and where the personal service provider appeals.
Furthermore, this paper discusses how the introduction of the invoice-based method affects the interpretation of the meaning of "business" from the viewpoint of the basic mechanism of consumption tax, that is, passing of the output tax and input tax credit.

2015 年3 月に北陸新幹線が金沢まで開通した。これを受けた金沢市は「金沢市観光戦略プラン2016」により、訪日外国人旅行者の受け入れ環境の整備・誘客の推進などの観光施策を展開した。国内外から多数の旅行客が訪れ、企業活動の活発化等が見られた一方、一部の観光スポットでは、旅行客による混雑やマナー違反など市民生活に多大な影響が生じたため、「市民生活と調和した観光まちづくり」が切に求められている。
本ヒアリング調査では、キャリア創生研究会メンバーが金沢市役所を訪問し、金沢市の観光行政と観光戦略について様々な観点からお話を伺った。以下は、文字おこし記録をもとに、三氏のご了解を得た内容をまとめた調査報告である。

石川県立図書館は旧館の老朽化を期に移転し、2022 年7 月に地上4 階・地下1 階建て、延べ床面積約2万2,700 平方メートル、約200 万冊の蔵書能力を持つ新館をオープンさせた1。「百万石ビブリオバウム」の愛称で知られる新館は、通常の閲覧エリアに加えて、研修室やラーニングスペース、モノづくりや食文化を体験できる文化交流エリアが充実した、多様な知的活動に開かれた文化施設として県内のみならず県外からも注目を集めている。本ヒアリング調査では、新館オープンに合わせて新たに図書館が導入したデジタルアーカイブ（DA）システム「SHOSHO ISHIKAWA」を中心に、図書館におけるDA 導入の目的と運用、地域の情報基盤整備、新館建築の特徴など多岐にわたるお話をお聞きした。DA は文化面から、観光を支える取り組みとしても期待されている。インタビューに応じてくださった小山氏・競氏に心より感謝申し上げます。
